TERMS & CONDITIONS OF OCCUPANCY AGREEMENT

This Occupancy Agreement (“Agreement”) is between Villa Paraiso Vacation Rentals LLC (“Villa Paraiso Vacation Rentals”) and the undersigned individual(s) (“Guest”). By submitting this form electronically, Guest confirms they have read and agreed to these Terms & Conditions, which comply with and reference relevant Florida laws including Florida Statutes §§ 509.141, 509.151, 82.045, 413.08, and related statutes.

1. BOOKING REQUIREMENTS & GUEST OBLIGATIONS

Age Requirement:The primary Guest must be at least Twenty-Five (25) years old and must occupy the property during the entire rental period. We do not rent to groups under 25 years old, and the named Guest must be present at all times during the stay. Active military personnel may qualify for exceptions.

Required Documentation:Within three (3) days of booking, Guest must provide:

  • A valid government-issued photo ID (driver’s license or passport)
  • Valid credit card information to be kept on file for incidentals, upgrades, and potential damages
  • Completed check-in form with all required guest information

Transient Occupancy Status:Guest acknowledges they are a transient occupant under Florida law, including §82.045 Fla. Stat., with no rights to tenancy or long-term occupancy.

Guest Conduct:We expect all guests to maintain reasonable and orderly conduct with respect to this Agreement, the property, applicable laws, and neighboring properties.

2. PAYMENTS & FEES

Currency:All payments and prices are in USD.

Reservation Deposit:50% of the total rental cost plus applicable fees is required to hold your reservation.

Final Payment:The remaining balance is due sixty (60) days prior to arrival. When booking a property less than 60 days before arrival, full payment is due at booking. If the final balance remains unpaid 60 days prior to arrival, Villa Paraiso Vacation Rentals reserves the right to cancel your reservation with no refund and re-list the property.

Payment Methods:We accept all forms of credit card/debit card payments. See your booking channel for more information.

Please note the above payments and fees policy does not apply to all booking channels. Please see your booking channel for more information on reservation deposits and final payments. Some booking channels may have different payment and fees terms than others. These booking channels, payments and fees above, are for our direct booking and also any other applicable booking channels.

Mandatory Fees:The following fees apply to all reservations:

  • Cleaning fee (varies by property)
  • Processing fee (varies by property and booking channel)
  • Florida State Sales Tax for Monroe County, or Miami-Dade
  • Applicable county and local taxes

Property-Specific Fees:Depending on the property, additional fees may include:

  • Pet fees ($250 per pet)
  • Pool heat fees ($250/week if requested before arrival; $325/week if added after check-in, plus applicable taxes and processing fees)
  • Resort fees
  • Boat slip fees

Published Rates:All rates are subject to change without notice prior to booking confirmation.

3. CANCELLATION & REFUND POLICY

48-Hour Full Refund Window:
Cancellations made within forty-eight (48) hours of booking will receive a full refund minus a $350 administrative processing fee.

61+ Days Before Arrival:
Cancellations made sixty-one (61) days or more prior to arrival are eligible for a 50% refund of all amounts paid, minus a $350 administrative cancellation fee.

Example:If total paid is $4,000 and Guest cancels 61+ days prior, refund = $2,000 (50%) minus $350 = $1,650 net refund.

60 Days or Less Before Arrival:
No refund of any amounts paid. No date changes or rebooking permitted. All payments are forfeited.

Late Arrival or Early Departure:
Does not warrant any refund or credit of the rental rate.

Booking Channel Policies:
Some booking channels may have different cancellation policies. Please refer to your specific booking platform for exact details. This policy applies to direct bookings with Villa Paraiso Vacation Rentals.

Travel Insurance Strongly Recommended:
We strongly urge all guests to purchase comprehensive travel insurance (such as Generali or similar providers, Villa Paraiso can refer a travel insurance partner after reserving). Unless mandated by law (such as official hurricane evacuation orders), no refunds will be issued beyond this stated policy. Travel insurance can protect you in cases of medical emergencies, flight cancellations, natural disasters, and other unforeseen circumstances.

4. DAMAGE WAIVER & GUEST LIABILITY

Nonrefundable Damage Waiver:
A $60 nonrefundable damage waiver fee is required for all reservations. This waiver covers accidental, unintentional damage to the property interior up to $3,000 with no deductible. This non-refundable damage waiver is baked into the cost of your reservation and it’s not an additional charge that is charged to you after reserving. Your reservation cost on your booking channel is all in.

Coverage Includes:

  • Appliances, furnishings, fixtures, and improvements of the residence premises (collectively “Protected Property”)
  • Personal property within the residence premises (belonging to the property owner)

Coverage Does NOT Include:

  • Land or real property structures
  • Guest’s personal property
  • Animals, birds, or fish
  • Motor vehicles, aircraft, watercraft, or their accessories
  • Credit cards, bank notes, securities, or financial instruments
  • Firearms and related equipment
  • Silverware, goldware, platinum ware
  • Business property
  • Intentional damage or gross negligence
  • Damage caused by unauthorized pets
  • Any violation of this Agreement

Immediate Reporting Required:
All damages must be reported to Villa Paraiso Vacation Rentals immediately upon discovery to qualify for waiver coverage.

Guest Liability Beyond Coverage:
Any damage exceeding $3,000, unreported damage, or damage not covered by the waiver will be charged to the Guest’s credit card on file. Guests are responsible for any damage caused by their party or invited visitors.

Alternative Security Deposit Option:
Guests may opt for a refundable security deposit instead of the damage waiver by contacting Villa Paraiso Vacation Rentals directly. Deposit amounts vary by property.

5. CHECK-IN & CHECK-OUT

Check-In Time:4:00 PM (may vary by property – check your property listing for specific times)

Check-Out Time:10:00 AM (may vary by property – check your property listing for specific times)

Early Check-In:
Available only if the property is not occupied the night before your arrival. Must be requested and approved in advance. Fee ranges from $100-$250 depending on property and availability. Requests cannot be made until 2 days prior to arrival and no later than 1 day prior. Unauthorized early arrival will result in a $250 fee.

Late Check-Out:
Available only if no guest is checking in on your departure day. Must be requested and approved in advance. Fee ranges from $100-$250 depending on property and availability. Requests cannot be made until 2 days prior to departure and no later than 1 day prior. Unauthorized late departure will result in a $250 fee.

Check-In Instructions:
Complete check-in instructions will be sent via email 2-3 days prior to arrival. Please check your inbox and spam folder. If you need instructions earlier due to travel plans, contact Villa Paraiso Vacation Rentals in advance.

Property Not Ready Upon Arrival:
If you arrive at your designated check-in time and cleaning is still in progress, please contact Villa Paraiso Vacation Rentals for an estimated completion time. Do not enter the property until cleaning is complete.

Check-Out Procedures:

  • Place used towels in a pile
  • Remove all trash from the property and place in appropriate containers
  • Follow property-specific trash and recycling pickup schedules (information provided in property welcome book)
  • Return all furniture (indoor and outdoor) to original locations
  • Close all umbrellas
  • Clean grill if used and ensure propane is turned off
  • Turn off all lights
  • Set air conditioning to 75 degrees
  • Close and lock all windows and doors
  • Return keys as instructed (lockbox, key basket, etc.)
  • Notify property manager of departure

Failure to follow check-out procedures may result in additional cleaning charges based on actual costs incurred.

6. OCCUPANCY LIMITS & QUIET HOURS

Maximum Occupancy:
Each property has a maximum occupancy limit based on local ordinances and property size. These limits are strictly enforced and include all adults, children, and infants. Maximum occupancy is clearly stated in each property listing.

Occupancy Violations:
Any guests exceeding the maximum occupancy will be charged $200 per additional guest per night. Repeated violations or refusal to comply will result in immediate eviction without refund. Villa Paraiso Vacation Rentals is not permitted to exceed the allotted occupancy under local regulations.

Day Visitors:
Day guests must be pre-approved by the property manager. A list with names and ages must be provided. No visitors are allowed at the property after 10:00 PM.

Quiet Hours:
To comply with Monroe County and local municipal ordinances, quiet hours are strictly enforced:

  • Marathon:9:00 PM to 9:00 AM daily
  • Key Colony Beach:9:00 PM to 9:00 AM daily (noise ordinance applies 24/7 – no excessive or disturbing noise at any time)
  • Miami-Dade County:9:00 PM to 9:00 AM daily

Please be mindful that sound carries easily near water. Neighbors have property manager contact information and are instructed to report violations.

No Parties or Unauthorized Events:
Unauthorized parties, gatherings, or events are strictly prohibited and may result in immediate eviction under Florida Statute §509.141. Social functions outside normal occupancy guidelines must be pre-approved in writing.

7. LOCATION-SPECIFIC REGULATIONS

MARATHON, FLORIDA

Minimum Night Stays:
The City of Marathon requires a minimum 7-night stay unless the property is under an HOA with different requirements. Please check individual property listings for specific minimum stay requirements.

Occupancy Formula:
Marathon calculates occupancy as the number of bedrooms plus two (2) additional persons, with a maximum of ten (10) persons total including all adults and children.

Local Compliance:
All guests must comply with City of Marathon short-term rental ordinances and regulations.

KEY COLONY BEACH, FLORIDA

Minimum Night Stays:
The City of Key Colony Beach requires a minimum 7-night stay unless the property is under an HOA with different requirements. Please check individual property listings for specific minimum stay requirements.

Occupancy Formula:
Key Colony Beach calculates occupancy based on square footage: one (1) person per two hundred (200) square feet. Properties 2,000 square feet or larger have a maximum occupancy of ten (10) persons. All property listings clearly state the maximum occupancy.

Key Colony Beach Specific Rules:

Noise Ordinance (24/7):
It is unlawful to make or continue any excessive, disturbing, unnecessary, or unusually loud noise which annoys, disturbs, injures, or endangers the comfort, repose, health, peace, or safety of others. This includes fireworks (sparklers are permitted). Violations: $250 per occurrence. (City Code 10-2,3)

Parking & Vehicles:

  • Parking in city right-of-way (between street and house) is restricted to property owner, invited guests, and renters only ($50/day violation)
  • Only one (1) recreational vehicle, boat trailer, utility trailer, or personal watercraft trailer per dwelling unit ($100/day violation)
  • Boat trailers and RVs may not extend over city right-of-way (20 feet from roadway centerline) ($100/day violation)
  • No vehicles, motorhomes, trailers, or campers may be used as a residence even for one night ($100/day violation)
  • Temporary boat trailer parking may be available off 8th Street for a fee paid at City Hall

Pets:

  • Maximum two (2) pets permitted ($100 violation for animals at large)
  • All animals must be leashed at all times ($100 violation)
  • Immediate removal of pet waste required ($50 violation)

Watercraft Regulations:

  • All watercraft must operate at IDLE SPEED/NO WAKE in Key Colony Beach waterways and landward of ocean buoys ($250 violation)
  • Living aboard a vessel is prohibited even for one night ($250 violation)
  • Rafting of vessels prohibited ($250 violation)
  • Overall boat length may not exceed property waterfront property lines; includes outboard motor in tilt-up position, pulpit, and anchor ($200/day violation)
  • Diving and snorkeling prohibited 4 days before mini-season through 10 days after commercial season opens in navigable canals, marinas, and within 300 feet of shoreline ($250 violation)

Garbage & Waste:

  • Garbage must be in cans with lids or heavy-ply refuse bags securely sealed
  • Collection: Tuesday & Saturday (early AM), Recycling: Tuesday only, Landscape debris: Wednesday only
  • Cans may be placed out no earlier than noon the day before collection; bags no earlier than 4 PM day before
  • Cans must be removed within 24 hours of collection ($50/day violation)

Fish Carcass Disposal:
When disposing of fish carcasses in canals:

  • Poke out the eyes
  • Break the spine and gut the fish
  • Ensure the carcass remains sunken on canal bottom as it decomposes
  • Do not create excessive accumulations of fish carcasses

Littering:
Littering on land or into water is strictly prohibited, including yard waste and cigarette butts. Discharging anything into canals is prohibited except as noted above for fish carcasses. ($250/day violation)

Speed Limit:
25 MPH on all city streets (per Florida Statutes)

Bicycles:

  • Must have white front lamp and red rear lamp/reflector between sunset and sunrise
  • Riders/passengers under 16 must wear helmets ($64.50 violation per F.S. 316.2065)

MIAMI-DADE COUNTY, FLORIDA

Local Compliance:
All guests must comply with Miami-Dade County short-term rental ordinances, noise regulations, and parking restrictions. Specific property rules will be provided in property welcome materials.

8. SMART HOME TECHNOLOGY & MONITORING

Remote Monitoring Systems:
Properties utilize smart home technology to ensure policy compliance and protect property systems. This may include:

  • Smart thermostats (to prevent excessive energy usage and system damage)
  • Smart door locks (for security and authorized access)
  • Pool/spa heater controls (to prevent equipment damage)
  • Decibel meters (to enforce quiet hours and noise ordinances)
  • Video surveillance (limited to front door, driveway, and pool/outdoor areas only)

Privacy Protection:
No cameras are installed in bedrooms, bathrooms, or any private interior spaces. If you discover any interior camera, notify Villa Paraiso Vacation Rentals immediately.

Tampering Prohibited:
Guest agrees not to tamper with, disable, damage, or cover any monitoring devices. Violations will result in a $500 fee per device plus cost of repair or replacement.

9. PET POLICY

Pet-Friendly Properties:
Not all properties allow pets. Pet-friendly properties are clearly marked in listings. Even if a property does not allow guest pets, the owner may have pets, so please inquire if anyone in your party has pet allergies.

Maximum Pets:
Most properties allow up to two (2) dogs. Select properties may allow up to four (4) dogs depending on property size and owner approval. Always confirm with Villa Paraiso Vacation Rentals before booking if you plan to bring more than two dogs.

Pet Fee:
$250 per pet, per stay (nonrefundable)

Weight Limit:
Maximum 50 pounds per dog unless a specific request is made and granted by Villa Paraiso Vacation Rentals.

Breed Restrictions:
The following breeds and mixes are not permitted due to insurance liability:

  • Pit Bulls (American Pit Bull Terrier, American Staffordshire Terrier, American Bully, Staffordshire Bull Terrier, American Bulldog)
  • Rottweilers
  • Doberman Pinschers
  • Chow Chows
  • Akitas
  • Presa Canarios
  • Wolf-dog hybrids
  • Any dog with a documented history of biting or aggressive behavior

If any prohibited breed is found on the premises, Guest will be asked to vacate immediately with no refund.

Cats & Other Animals:
Cats require explicit written approval. Other animals (birds, reptiles, pigs, rabbits, etc.) are not permitted under any circumstances.

Unauthorized Pets:
If evidence of an unauthorized pet is found:

  • Pet-friendly property with unpaid fee: $300 charge per pet
  • Non-pet-friendly property: $500 charge per pet AND immediate eviction without refund

Pet Rules:

  • Pets must be crated when left alone in the property
  • Pets not allowed on furniture or bedding
  • Pets not allowed in pool or pool area
  • Pets must be leashed (maximum 5-foot leash) and under control at all times when outside
  • Immediate removal of all pet waste required (biodegradable bags should be used)
  • Pets must be current on all vaccinations including rabies, bordetella, and tick/flea treatments
  • Pets not allowed in property during service technician visits

Guest Liability:
Guest is fully responsible and liable for:

  • Any property damage caused by the pet
  • Any personal injuries caused by the pet
  • All associated costs and claims

Service Animals:
Service Animals as defined by Florida Statute §413.08 are permitted and exempt from pet fees when properly disclosed and documented. Service Animals are dogs (or in some cases miniature horses) trained to perform specific tasks for individuals with disabilities.

Emotional Support Animals (ESA):
ESAs are NOT Service Animals under the ADA or Florida law. ESAs are subject to standard pet rules, fees, and breed restrictions. Misrepresenting an ESA as a Service Animal is a misdemeanor under Florida law.

10. SMOKING POLICY

Indoor Smoking Prohibited:
Smoking and vaping are strictly prohibited inside all properties.

Outdoor Smoking:
Smoking is permitted in designated outdoor areas only. Please properly dispose of all cigarette butts and smoking-related waste.

Evidence of Indoor Smoking:
If there is evidence of smoking inside the property, the following charges apply:

  • $500 fine, plus
  • All costs to remove evidence of smoking (typically includes dry-cleaning window treatments and bedspreads, shampooing upholstery and carpets, replacing air filters)
  • Immediate eviction without refund

By signing this Agreement, Guest authorizes Villa Paraiso Vacation Rentals to charge the credit card on file for all expenses related to indoor smoking violations.

11. POOL, SPA & WATER SAFETY

Use At Your Own Risk:
Use of swimming pools, hot tubs, and spas is entirely at Guest’s own risk. All guests assume all risks and waive the right to file suit against the property owner and/or Villa Paraiso Vacation Rentals for any loss, damage, injury, or liability that may occur.

NO DIVING:
Diving is strictly prohibited at all pools.

Supervision Required:
An adult MUST supervise children at all times. Child drowning tragedies occur every year in Florida. While our pools are gated or caged, parents and guardians play the critical role in prevention.

Pool Heat (Optional Service):
Pool heat must be requested at least one (1) day before arrival to allow sufficient warm-up time:

  • $250 per week (plus applicable taxes and processing fees) if requested before arrival
  • $325 per week (plus applicable taxes and processing fees) if added after check-in

Pool temperature is typically set between 84-88 degrees Fahrenheit. Pool heat may take up to 48 hours to reach maximum temperature. 

Pool Rules:

  • No pets in pool or pool area
  • No glass or breakable objects around pool
  • Keep area clean and orderly
  • Young children must wear swim diapers (not regular diapers)
  • No balloons poolside (can cause expensive pump/deck damage)
  • Pool gates and enclosure doors must remain closed and secured at all times

Pool Service & Maintenance:
Pools are serviced weekly. Please notify Villa Paraiso Vacation Rentals immediately if there are any problems or concerns.

12. WATERFRONT PROPERTIES, BOATS & DOCKS

Verification Required:
Guest is responsible for verifying dock length, canal depth, and canal width before booking to ensure their boat will fit. Please contact Villa Paraiso Vacation Rentals with your boat specifications if you have any questions.

Boat Size Restrictions:
Boats over thirty-two (32) feet are typically prohibited, depending on the property and dock configuration. Some properties may accommodate larger boats. Please contact Villa Paraiso Vacation Rentals for approval if your boat exceeds 32 feet.

Dock Suitability:
Villa Paraiso Vacation Rentals assumes no responsibility if the Guest’s boat does not properly fit at the dock. It is solely the Guest’s responsibility to verify suitability before booking.

Boat Trailers:
Boat trailers are allowed at most properties with specific written permission. Guest must verify trailer storage availability (on-site or off-site) before arrival. Additional fees may apply.

Storm Safety:
Guest must remove any boat and not use the dock if a severe storm warning or tropical storm watch is in effect. Boats left at docks during storms are at Guest’s sole risk.

Florida Boating Regulations:
Guest must comply with all Florida boating regulations including Chapters 327 & 328 of the Florida Statutes and all local ordinances.

Bait Freezers:
If the property has a bait freezer and you have leftover bait, please either:

  • Feed the fish, or
  • Leave it in the bait freezer and notify the property manager so the next guest or owner can be informed

Do not dispose of bait in regular trash.

Waiver of Liability:
By signing this Agreement, Guest acknowledges the inherent risks of waterfront activities and accepts full responsibility for themselves and their party for all watercraft-related activities.

13. GRILLS & OUTDOOR AMENITIES

Grill Type:
Properties may have gas (propane) or charcoal grills. Please check property listing or confirm with property manager.

Propane Replacement:
If you run out of propane during your stay, you may exchange the tank at Circle K, Publix, or Walgreens. Send a photo of the receipt along with the property name/address and reservation name to Villa Paraiso Vacation Rentals for reimbursement.

Grill Cleaning Required:
Guest must clean the grill and leave it in the same condition as found. Failure to properly clean the grill will result in an additional cleaning fee based on actual costs incurred.

Beach Chairs & Towels:
Some properties provide beach chairs and/or beach towels. Please return all items to the property each night. Replacement costs:

  • Beach chair: $100 per chair
  • Beach towel: $25 per towel

Check property description or confirm with property manager regarding availability of these items.

14. UTILITIES & AMENITIES

Television, Internet & Phone:
Most properties include cable/satellite TV, WiFi internet, and telephone service. However, not all properties include these amenities or include them in every room. While WiFi is provided where available, Villa Paraiso Vacation Rentals cannot guarantee internet speed or reliability due to infrastructure limitations in some areas.

Service Interruptions:
Villa Paraiso Vacation Rentals is not responsible for temporary interruptions in utility services including but not limited to:

  • Water, gas, or electricity supply
  • Internet or cable service
  • Telephone service
  • Air conditioning (see maintenance policy below)
  • Any services beyond our control

No refunds or credits will be issued for temporary service interruptions. Guests are not entitled to credit card chargebacks for service interruptions.

Pay-Per-View & Purchased Services:
Any Pay-Per-View programming, downloaded games, movies, or other services not billed to Guest’s own payment method will be charged to the credit card on file.

Property-Specific Amenities:
Guest is responsible for confirming which amenities each property includes by reviewing property descriptions, photos, and/or confirming with the property manager. Not all properties include ice makers, bait freezers, bicycles, kayaks, paddle boards, or other recreational equipment. Villa Paraiso Vacation Rentals is not responsible if these items are not provided or are not in working condition.

15. VEHICLES & PARKING

Parking Limits:
Guest must confirm how many vehicles the property can accommodate. Parking limits vary by property and location.

RVs, Boats & Trailers:
RVs, motor homes, boats, motorcycles, trailers, and similar vehicles are not permitted without specific approval and may incur additional charges. At no time are boats, RVs, or vehicles to be used for accommodation or connected to the main property’s utilities.

Refer to Location-Specific Sections:
Additional parking restrictions apply in Key Colony Beach and other municipalities. Please review Section 7 for location-specific parking regulations.

16. PROPERTY CONDITION & MAINTENANCE

Property “As-Is”:
Properties are rented in “as-is” condition. Minor changes or normal wear and tear may differ slightly from listing photos. Villa Paraiso Vacation Rentals and property owners make every effort to ensure accuracy of descriptions and photos, but cannot guarantee perfect accuracy.

Maintenance Issues:
If plumbing, air conditioning, appliances, or other systems malfunction, notify Villa Paraiso Vacation Rentals immediately so we can address the issue promptly. No refunds will be issued for minor or temporary service outages or routine maintenance needs.

Tropical Environment:
The Florida Keys and Miami are located in a tropical environment. The following are common and beyond our control:

  • Insects:Ants, mosquitoes, no-see-ums, palmetto bugs, scorpions, and other pests are very common. Every precaution is taken, but we cannot guarantee the interior will be completely free of insects at all times.
  • Seagrass:During certain times of year, seagrass can accumulate in canals or on shorelines. Seagrass has a distinct and unpleasant odor. Villa Paraiso Vacation Rentals is not responsible for seagrass presence or removal, and no refunds will be issued for seagrass occurrences.

Construction & External Conditions:
Villa Paraiso Vacation Rentals will do our best to inform guests of any known construction near rental properties. However, we are not responsible for construction on roadways, utility easements, or surrounding properties, and no refunds or credits will be issued for construction-related inconvenience.

Property Changes:
Policies, descriptions, conditions, rates, and amenities are subject to change without notice at any time before occupancy.

17. PROPERTY LISTED FOR SALE

Potential Showings:
Properties may be listed for sale during your stay. Real estate agents are required to provide twenty-four (24) hour notice for showing requests. The property manager and listing agent will be present during all showings.

If Villa Paraiso Vacation Rentals does not receive a response from Guest regarding a showing request, it will be assumed there is no objection and the property will be shown at the requested time.

Sale Before Arrival:
If a property sells before Guest’s arrival and the new owner will not honor the reservation, Villa Paraiso Vacation Rentals will make every effort to find a comparable alternative property. If no suitable alternative is found, Guest will receive a full refund.

18. LOST & FOUND

Guest Responsibility:
Please thoroughly check the property before departure to ensure you have collected all personal belongings.

Items Left Behind:
Any items left behind will be logged by cleaning staff or property manager with the date and property location. Unless items are of extreme importance (passport, plane tickets, wallets, medications), Villa Paraiso Vacation Rentals may not proactively contact you about found items.

Shipping:
If you discover you left items behind after returning home, you will be charged the actual cost of shipping to return the items.

Unclaimed Items:
Items unclaimed after forty (40) days will be donated or discarded.

19. HURRICANE, WEATHER & FORCE MAJEURE

Hurricane Season:
Hurricane season in Florida runs from June 1 through November 30. We strongly recommend purchasing comprehensive travel insurance if traveling during this period.

Mandatory Evacuation:
If local or state authorities issue a mandatory evacuation order for the rental area, Guest agrees to vacate the premises immediately. Guests who have not purchased travel insurance will receive a prorated credit refund for any unused nights due to mandatory evacuation. Guests holding confirmed reservations who are unable to travel due to mandatory evacuation and closure of local airports or connecting roadways will receive a refund for any unused portion if they do not have travel insurance.

Storm Damage:
If a property is damaged and uninhabitable due to a hurricane or storm, Villa Paraiso Vacation Rentals will make every effort to relocate Guest to a similar property or provide a full refund.

Weather Not Covered:
No refunds will be issued if:

  • A hurricane is not a direct threat to the Florida Keys but causes flight cancellations or adverse travel conditions outside the Keys
  • Inclement weather occurs without official evacuation orders
  • Guest chooses not to travel due to weather forecasts without official orders

Force Majeure:
Neither party shall be liable for failure to perform obligations under this Agreement if such failure results from Acts of God (including fire, flood, earthquake, storm, hurricane, or other natural disaster), war, invasion, act of foreign enemies, hostilities, civil unrest, rebellion, revolution, insurrection, terrorism, government sanctions, blockage, embargo, labor disputes, strikes, pandemic, epidemic, government-ordered shutdowns, or any other cause beyond reasonable control of the party.

In such circumstances, Guest may rebook for a future date within twelve (12) months, subject to availability and any applicable rate differences, or receive a refund as outlined above for mandatory evacuations.

20. EVICTION & REMOVAL

Grounds for Eviction:
Villa Paraiso Vacation Rentals may immediately remove or cause to be removed any Guest or occupant who:

  • Illegally possesses or deals in controlled substances
  • Violates any term of this Agreement
  • Is intoxicated, profane, lewd, or brawling
  • Indulges in language or conduct that disturbs the peace and comfort of other guests or neighbors
  • Creates a nuisance or injures the reputation, dignity, or standing of the property
  • Fails to make timely payment of fees
  • Fails to check out at the agreed-upon time without written extension approval
  • Exceeds maximum occupancy limits
  • Hosts unauthorized parties or events

Official Notice:
Any notice to vacate may be given orally or in writing. If in writing, the notice shall state:

“You are hereby notified that this establishment no longer desires to entertain you as its guest, and you are requested to leave at once. To remain after notification is a misdemeanor under State Laws.”

Law Enforcement:
Law enforcement will remove Guest and Guest’s party if they do not leave voluntarily.

No Refund:
Any guest evicted for violations of this Agreement will forfeit all rental fees paid and will not receive any refund.

Compliance with Florida Law:
This eviction policy complies with Florida Statute § 509.141.

21. FEES & FINES SCHEDULE

The following fees apply to specific violations or circumstances:

These fees address unauthorized or willful violations. Standard wear and tear or accidental damage up to $3,000 is typically covered by the Damage Waiver (see Section 4).

22. LEGAL TERMS & LIABILITY

Forum & Choice of Law:
The 16th Judicial Circuit of Florida (Monroe County) shall have exclusive jurisdiction for any litigated claims arising from this Agreement. Florida law applies exclusively.

Arbitration:
Claims exceeding $15,000 shall be subject to binding arbitration per American Arbitration Association (AAA) rules.

Attorneys’ Fees:
The prevailing party in any dispute or litigation arising from this Agreement is entitled to reasonable attorneys’ fees and costs.

Indemnification & Hold Harmless:
Guest shall defend and hold Villa Paraiso Vacation Rentals, its owners, agents, and employees harmless from any third-party claims, liability, demands, actions, causes of action, expenses, damages, losses, or injuries sustained by any person including Guest, Guest’s family, agents, guests, or invitees as a result of or arising from Guest’s occupancy.

This includes but is not limited to claims arising from use of pools, hot tubs, spas, open water (ocean, gulf, bay), water areas, docks, bunk beds, grills, fire pits, water toys, floats, kayaks, bicycles, paddle boards, and any other amenities whether supplied by the owner or not.

Guest shall also be liable and indemnify Villa Paraiso Vacation Rentals for attorneys’ fees and court costs incurred in enforcing any terms of this Agreement.

Third-Party Services & Vendors:
Villa Paraiso Vacation Rentals may recommend third-party service providers (such as chefs, boat rentals, tours, water sport operators, childcare, fishing charters, etc.) as a courtesy. Guest agrees to hold Villa Paraiso Vacation Rentals harmless from any liability, damage, cost, or expense related to Guest’s use of any such recommended services or vendors. Any vendor or service used by Guest is solely at Guest’s discretion and risk.

Non-Liability for Personal Property:
Villa Paraiso Vacation Rentals and property owners are not liable for loss of, damage to, or theft of any personal property belonging to Guest. Villa Paraiso Vacation Rentals’ property insurance does NOT cover Guest’s personal belongings. Guest is strongly encouraged to obtain travel insurance that includes personal property coverage.

Guest further agrees that neither Villa Paraiso Vacation Rentals nor property owners or employees shall be liable for any damage to personal property arising from theft, vandalism, fire, water, rain, acts of God or government, interruption of utilities, acts of third parties, or other external causes.

Falsified Information:
Any falsified information provided during booking (including but not limited to age, identity, number of guests, or purpose of stay) constitutes a material breach of this Agreement and may result in immediate termination without refund and additional charges.

Credit Card Chargebacks:
Per Florida Innkeepers Statute § 509.151 Fla. Stat., disputing a valid charge after occupying the property may be considered a felony. All refund requests or billing disputes must be handled through Villa Paraiso Vacation Rentals’ grievance and dispute resolution procedures or through the legal processes outlined in this Agreement. Unauthorized chargebacks may result in legal action.

Entire Agreement:
This Agreement supersedes all prior verbal or written statements, representations, or agreements. Only an authorized agent of Villa Paraiso Vacation Rentals may amend these Terms in writing.

Severability:
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.

Electronic Execution:
This Agreement may be signed electronically and/or in counterparts, and is effective upon Guest’s acceptance (electronic signature or click acceptance).

23. ACKNOWLEDGMENT & SIGNATURE

By signing below, Guest acknowledges that they:

  • Are at least 25 years of age
  • Have read, understand, and agree to all Terms & Conditions outlined in this Agreement
  • Understand this is a legally binding contract
  • Agree to hold Villa Paraiso Vacation Rentals harmless as outlined in this Agreement
  • Authorize Villa Paraiso Vacation Rentals to charge the credit card on file for any fees, fines, damages, or charges incurred during their stay
  • Acknowledge they are a transient occupant with no tenancy rights under Florida law
